TERMS AND CONDITIONS FOR PARTICIPATION IN THE MOSAIC CHALLENGE
1. INTRODUCTION
The Mosaic Challenge is one of the activities included within the Small Things Matter awareness campaign, promoted by Pharma Mar — an awareness-raising initiative aimed at giving greater visibility to small cell lung cancer and increasing public understanding of the reality faced by those living with this disease.
As part of this awareness campaign, participants are invited to share photographs of those “small things or moments” that make life special: a walk, a game of chess, reading a book, or a child’s latest drawing (hereinafter, the “Mosaic Challenge”).
For each photograph submitted to the Mosaic Challenge, Pharma Mar, as a demonstration of its commitment to patients and to society, will donate five euros (€5) to patient associations dedicated to raising visibility and awareness of small cell lung cancer, up to a total donation amount of ten thousand euros (€10,000).
The terms and conditions for participation in the Mosaic Challenge are set out below in Section 2.
2. TERMS AND CONDITIONS
These terms and conditions (hereinafter, the “Terms”) establish the contractual provisions governing participation in the Mosaic Challenge.
2.1. Participants and the theme of the photograph
2.1.1. Any person aged 18 or over may take part in the Mosaic Challenge.
2.1.2. The theme of the photograph is an essential requirement of these Terms and must be related to the campaign to raise visibility and awareness of small cell lung cancer. To comply with this theme, participants may, by way of example, share a photograph that represents those “small things or moments” that make life special.
The theme is entirely open: the photograph should capture a detail, gesture, or object that represents something special for the participant — something that may not necessarily be meaningful to others, but holds personal significance for the person uploading the image.
Participants must avoid sharing any photograph (with or without a title) that bears no relation to the campaign, promotes prescription-only medicines owned by Pharma Mar, or features controversial, discriminatory, offensive or derogatory content.
Under no circumstances may participants submit photographs created or altered using artificial intelligence software, applications or tools.
2.1.3. A committee made up of Pharma Mar personnel (hereinafter, the “Committee”) will ensure that all submitted photographs respect the spirit and theme set out in this section of the Terms.
2.2. Submission, acceptance, withdrawal and publication of the photograph
2.2.1. Photographs must be shared via the section provided for this purpose on the website https://smallcelllungcancermatters.com/ (hereinafter, the “Website”), within the period indicated on the Website.
At the time of registration, participants must provide their full name and email address. Once registered, an automatically generated password will be sent to their email inbox, allowing them to access the dedicated section of the Website.
Submissions made through any other means will not be considered by the Committee.
Each participant may share a maximum of one (1) photograph.
Accepted formats: JPG, JPEG, PNG.
Participants may replace their initial photograph with a different one by accessing their profile, provided this is done within the submission period (see Section 2.4).
Participants may also withdraw their photograph via their profile during the same period, but must be aware that withdrawal (as opposed to replacement) means non-participation in the Mosaic Challenge.
After the deadline, if a participant wishes to withdraw their photograph, they must send an email to: mosaic.challenge@pharmamar.com.
Any participant wishing to delete their profile must send a request to the same email address.
2.2.2. The Committee will review all photographs and may reject those (with or without a title) that, by reason of their content or title, do not align with the spirit of the campaign described in Section 2 of these Terms.
Rejected photographs will not take part in the Mosaic Challenge.
In the case of acceptance, the photograph will participate in the Mosaic Challenge and be published on the corresponding section of the Website.
Participants will be informed of the Committee’s decision (acceptance or rejection) by email — used exclusively for that purpose.
The Committee’s decision will be final and binding.
2.2.3. Photographs accepted by the Committee will be published on the relevant section of the Website once the submission period has ended (see Section 2.4).
All photographs published on the Website at the close of the Mosaic Challenge will together form a collective mosaic.
2.3. Rights to the photograph
2.3.1. The participant authorises Pharma Mar to use the photograph for the purpose of managing participation in the Challenge, as well as for any other institutional, educational, awareness-raising or public information use — potentially in collaboration with patient associations — that may be promoted or supported by Pharma Mar, in any media (owned or third-party) and in any format or medium, without time limitation, free of charge and without geographical restriction.
2.3.2. The participant submitting the photograph declares and warrants that they hold all necessary rights to share the image in accordance with these Terms, releasing Pharma Mar from any liability and indemnifying Pharma Mar against any loss or damage arising from the use of the photograph as set out herein.
In particular, if the photograph features identifiable individuals or creative works protected by intellectual property rights, the participant declares that they have the necessary authorisation to include them.
2.3.3. Participants may not make any use whatsoever of photographs submitted by other participants and published on the Website in connection with the Mosaic Challenge.
2.4. Submission period
The submission period for photographs will be that indicated in the relevant section of the Website.
Photographs submitted after the deadline will not be accepted.
2.5. Personal data protection
In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD), participants are hereby informed that participation in the Mosaic Challenge involves the processing of personal data, both of the participant and of any individuals appearing in the submitted photograph.
The following information is provided regarding this data processing:
- Data controller: Pharma Mar S.A., Avda. de los Reyes 1, Polígono Industrial “La Mina”, 28770 Colmenar Viejo (Madrid).
- Categories of personal data processed: Name, surname, email address, username, password, and image of any individuals appearing in the photograph. The email address will be used solely to manage participation in the Mosaic Challenge.
- Prohibited data: Participants must not include in their submissions any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data for unique identification, health data, or data concerning sexual orientation or sexual life.
- Purpose of processing: To manage participation in the Mosaic Challenge; to collect, store, reproduce and distribute the image; and to include the photograph in internal documentation, intranet, communication media or Pharma Mar’s own profiles, such as social networks, websites (including https://smallcelllungcancermatters.com/), multimedia platforms, brochures, reports, or any other content or document related to the awareness campaign or Pharma Mar itself, with the aim of increasing visibility and awareness of small cell lung cancer and promoting understanding of the reality faced by those living with this disease.
- Legal basis for processing: The legal basis for processing personal data will be the consent of the individuals appearing in the photographs and Pharma Mar’s legitimate interest in managing the campaign, the Mosaic Challenge, raising visibility and awareness of small cell lung cancer, and increasing public understanding of the disease. Submission of a photograph to the Mosaic Challenge necessarily implies that the participant has obtained the consent of all individuals appearing in the image after providing them with the information contained in this document.
- Data retention period: Personal data will be retained for the duration of the Mosaic Challenge and subsequently for a period of six (6) years, in order to comply with possible legal obligations. Participant profiles will be blocked once the Mosaic Challenge ends.
Regarding image processing, unless stated otherwise, data will be retained while appearing in internal or external communication media and until the participant exercises their right to deletion or withdraws consent. Participants may withdraw their photograph from the Mosaic Challenge at any time. - Data communication: Data will be published on the intranet and on the Website https://smallcelllungcancermatters.com/, and therefore made accessible to third parties visiting the Website. Photographs may also be shared with patient associations collaborating with or interested in the Mosaic Challenge. Additionally, service providers acting on behalf of Pharma Mar may access the data. No international data transfers will take place.
- Consent: Participants are free to grant or withhold consent by marking the corresponding checkbox when registering to participate in the Mosaic Challenge. Failure to grant consent for the collection, processing and communication of the indicated data, including the image, will prevent participation in the Mosaic Challenge. Registration in the initiative entails receiving the necessary emails to manage participation.
- Data subject rights: Participants may exercise at any time their rights of access, rectification, erasure, data portability, restriction or objection to processing, as well as the right to withdraw consent (without affecting the lawfulness of prior processing) by contacting dpo@pharmamar.com.
Participants are also informed of their right to lodge a complaint with the Spanish Data Protection Agency if their rights are not properly respected (https://www.aepd.es/en).
3. ACCEPTANCE OF THE TERMS
3.1. Participation in the Mosaic Challenge implies full and unconditional acceptance of these Terms.
3.2. Any breach of these Terms authorises the Committee to take the measures it deems most appropriate to protect the spirit of the Mosaic Challenge.
3.3. These Terms shall be governed by Spanish law.
